Hello, my name is Emma Tally, I am 14 years old and a Freshman in school.  I have been an active member of the Tyler County 4H since 3rd grade. In my Chapter I have been elected County 4H Reporter for 1 year, and I currently hold the position of County 4H Treasurer which I have held for 3 years. I live on a small farm in Colmesneil, Texas and when I am not working with my animals I have many other interests. I enjoy painting art, and doing woodworking and have won at our county fair with some of my projects. I also enjoy ballet/lyrical dance and have been with a dance company for 4 years doing weekly practice. I am a member of my local Spinners and Weavers guild and I like to spin wool into yarn on my spinning wheel, which I do for our local Art Festival. I am also active in my church and my youth group, my faith in God is first in my life and all glory I give to Him. My future plans after high school are to attend college to pursue a degree in business.

My 4H project this year was a market lamb. Her name is Ms. Magnolia and though it was the first time I had ever had a lamb I wanted to learn more and educate myself on how to take care of her. It was a challenge to me to work with her so that she could look her best, and I am so proud of her and the results.

YMBL TERMS AND CONDITIONS: By accepting these terms and conditions you agree to be jointly and severally liable and hereby purchase from the Young Men's Business League of Beaumont, Texas, Inc. ("YMBL") the animal(s). In order to secure payment of the purchase price, Buyer(s) do(es) hereby grant(s) a security interest in the livestock purchased. If Buyer(s) default(s) in payment, the YMBL may foreclose its security interest in accordance with Article 9 of the Texas Uniform Commercial Code. Buyer(s) hereby acknowledge(s) that the YMBL makes absolutely no warranty whatsoever as to the fitness of animals purchased hereunder for any purpose or intended use, nor as to their merchantability. Such animals are bought on an AS IS basis. All claims and causes of action against the YMBL arising out of the sale of the animal(s) are hereby waived even if such claim(s) arise from negligence on the part of the YMBL or its agents. The YMBL Auction is a TERMINAL auction for steers, swine, goats and lambs. The F-1 Commercial Heifers are excluded from being terminal. TERMINAL IS DEFINED AS AFTER THE ANIMAL IS SOLD IT WILL BE SENT TO SLAUGHTER. BUYER WILL PICKUP THEIR MEAT AFTER THE ANIMAL HAS BEEN PROCEESED. 

 

It is agreed that payment for such animal(s) is to be made to the YMBL at the time this agreement is executed by Buyer(s). 

IN THE EVENT PAYMENT IS NOT MADE IMMEDIATELY, THE FOLLOWING PROMISSORY NOTE IS A PART OF THIS AGREEMENT: 

For value received, I, We or either of us, as principals, (referred to as "Buyer(s)" herein), promise to pay to the order of the Young Men's Business League of Beaumont, Texas, inc.("YMBL") in the City of Beaumont, Jefferson County, Texas in legal and lawful money of the United States of America, with no interest thereon from the date hereof until maturity; matured unpaid principal shall bear interest from date of maturity until paid at the rate of ten percent (10%) per annum. This note is due and payable as follows: On or before thirty (30) days from the date of this note. 

It is expressly provided that upon default in the punctual payment of this note or any part thereof, principal or interest, as the same shall become due and payable, the entire indebtedness secured by the hereinbefore mentioned lien shall be matured, at the option of the holder; and in the event default is made in the prompt payment of this note when due or declared due, and the same in placed in the hands of an attorney for collection through Probate, Bankruptcy or other judicial proceedings, then the maker(s) agree(s) and promise(s) to pay a reasonable sum as attorney's fees. 

Each maker of this note expressly waives all notices, demands for payment, presentations for payment, notices of intention to accelerate the maturity, protest and notice of protest, as to this note.

STOCK SHOW AUCTIONS TERMS and CONDITIONS

ADD ONS: Those desiring to assist individual exhibitors through financial aid may place “Add-ons” on specific lots. These add on monies will be credited to the student exhibitor less applicable sale expenses (if applicable). There is no transfer of lease or ownership implied to any lot by placing “add- ons” on a lot. Add-ons are to be strictly considered a gift to the student exhibitor.

SANCTIONED SALE:  This is a sanctioned sale and is an event that is offered by a 501© 4 non-profit organization and utilizes the hosting and sale management of StockShowAuctions.com. All monies paid by buyers will be invoiced by StockShowAuctions.com but paid directly to the non-profit organization. Buyers will NOT receive federal income tax deductions for the amount paid to this non-profit organization.

CONDITIONS: Any person placing bids on items in this auction agrees to these terms and conditions and understands that, by placing bids, they are entering into a binding contract between themselves and the consignor(s) and that they will be held financially responsible for their actions. Auctioneer serves only as an agent for the seller and may not be held responsible for any livestock or merchandise. It is to be clearly understood that Auctioneer; StockShowAuctions.com and representatives act only as a means between buyer and seller, and may not be held liable, financially or otherwise, for any failure on the part of the same to fulfill any obligations set forth in this sale or for the truth of any warranties expressed or implied. This catalog of offering has been prepared by the auctioneer from information provided by the seller(s) and is assumed accurate as presented to us. Auctioneer in no way guarantees age, pedigree, or reproductive status of the animals selling. All agreements and adjustments made are between buyer and seller and should be done in writing.

CHECK OFF FEES: Seller and seller alone is responsible to remit any check-off type fees required by law. Seller assumes this responsibility and releases and will indemnify and defend Auctioneer and buyer(s) from seller’s failure to remit such payment to the appropriate agencies.

BIDDER SECURITY: As a Bidder, you are responsible for any bids placed by you or a designated representative under your bidding number and password. The security of your Bidder information is your sole responsibility and the Bidder will be responsible for any and all bids placed under the assigned number. If, at any time, you feel that your Bidder number and password have been compromised, due to lack of security on your part, you must notify Auctioneer immediately.

BID RETRACTIONS: There are no bid retractions. ALL BIDS ARE NON-CANCELLABLE ONCE SUBMITTED. Once a bid is made and confirmed, it cannot be retracted. When a bid is made you manifest your intent and ability to buy the lot at the bid price. A false or fraudulent bid will result in legal action. Any winning Bidder who refuses to purchase the lot may be banned from all future auctions.

AT YOUR OWN RISK: Auctioneer is not responsible for injury or accidents. All animals become property of the buyer at the conclusion of the auction.
